CONDIZIONE GENERALI-GENERAL CONDITIONS
By submitting this form, the parent and/or guardian authorises the minor participant to register and participate in the RMAX CHAMPIONSHIP 2026 events.
Furthermore, the adult participant, parent and/or guardian declares under their own responsibility from the moment of purchase until 31 December 2026:
• to exempt TBKART srl, the Race Officials, the track owner, all persons involved in the organisation and anyone else who, in any capacity, collaborates in the organisation and promotion of the race, from any and all liability and/or damage that may arise from their participation in the race itself, as well as their drivers, employees or property;
• to undertake, during the competition, to use protective safety clothing and a helmet approved in accordance with current regulations and to comply with the sporting rules and specific regulations of the event, exempting TBKART srl, the Race Officials, the track owner, all persons involved in the organisation and anyone else who, in any capacity, collaborates in the organisation and promotion of the race, from any and all liability and/or damage that may arise from their participation in the race itself.
• to be attentive to their own safety and that of others.
• to have read and comply with the regulations in force at the host facility (racetrack, track, karting track, mini-track, etc.) available on the official website of the Facility and at the Race Management office, as well as the regulations relating to safety in the workplace
• Accept this form as a sign of approval of the data processing methods, specifically and expressly for the processing of data in accordance with European Regulation No. 679/2016 and Legislative Decree 196/03 and subsequent amendments and additions, and expressly consent to the communication and dissemination of their personal data in accordance with the same law;
• To unconditionally approve, pursuant to Articles 1341 and 1342 of the Civil Code, the Aci Karting Sporting and Technical Regulations, the IRK PROMOTION Sporting Regulations and the Specific Race Regulations.
• that compensation for any damage caused directly or indirectly:
l) to structures, karts and equipment
2) to other drivers and their vehicles
3) to third parties, whether spectators or members of the organisation.
will be entirely and exclusively borne by the driver, relieving TBKART srl of any liability in relation to the occurrence and verification of the events described in the preceding paragraphs, and indemnifying TBKART srl against any claims for damages that may be made against it by third parties for the reasons described above;
•to grant TBKART srl authorisation, without remuneration, to use photographs, videos and other material relating to my participation in the event for informational, promotional or editorial purposes.
• To exempt TBKART srl from any liability in the event of my psychological or physical unsuitability to carry out the activities planned for the event.
The undersigned therefore assumes full and exclusive responsibility for his/her state of health.
The lack, even partial, even if supervening, of a state of mental and physical health suitable for carrying out even one of the planned activities, does not constitute the responsibility of TBKART srl or grounds for recourse against it in the event of damage, of any nature and extent, to the Customer, the host facility, the staff of the host facility or third parties; Aware of the consequences in the event of false or misleading statements pursuant to Presidential Decree no. 445/2000. Consents to the processing of personal data pursuant to the GDPR, EU Reg. no. 679/2016.
• Exclusion of the Right of Withdrawal
Pursuant to Article 59, paragraph 1, letter n) of Legislative Decree 206/2005 (Consumer Code), the Customer is informed that the right of withdrawal is excluded for contracts providing for the supply of services relating to leisure activities, if the contract provides for a specific date or period of performance (see the events calendar on the website www.irkpromotion.com).
The go-kart racing package purchased falls within this category, as it is a service with specific, reserved dates and times. Therefore, once the purchase has been confirmed, it will not be possible to exercise the right of withdrawal or request a refund, unless the activity is cancelled for reasons attributable to the organiser.
By making the purchase, the Customer expressly accepts the loss of the right of withdrawal, aware of the nature of the service offered.
